We are The Oud Section LTD, a company registered in England and Wales under Company Number 14750412 and with our registered Office at 128 City Road, London, United Kingdom, EC1V 2NX. https://oudsection.co.uk/ is an online service of The Oud Section LTD provided solely for your personal use for the sale of oud perfume oil and other Items.

DEFINITIONS

In this document, ‘we’, ‘our’ and ‘us’ refer to The Oud Section, and ‘user’, ‘you’, ‘your’ and ‘customer’ mean users of the Services. ‘Dispatch Confirmation’ means the date on which we email you to confirm our acceptance of your order and dispatch of the Goods. ‘Goods’/ ‘Item’ means the items which we agree to sell you.

USE OF THE SITE

These Terms and Conditions of Website Use ('Terms') apply to your use of the Oud Section websites located at https://oudsection.co.uk/.

You must be 18 years old or the age of majority in your jurisdiction in order to use our Services. If you are under 18 years old or the age of majority in your jurisdiction, then you may only use the Services with your parent or legal guardian's permission. These Terms along with our Privacy Policy and Cookie Policy constitute a legally binding agreement between you and us. By accessing or using our Services, you agree that you (or your parent or legal guardian) have read, understand, and are bound by the terms and conditions set forth herein. We may from time to time change these Terms at our sole discretion. By using this Website after any such change(s), you agree to comply with, and be bound by, the Terms as changed.

PLACING AN ORDER
  • Our Site’s pages guide you through the steps you need to take to make a purchase with us. Our order process allows you to check and amend any errors before submitting your order to us. Please take the time to read and check your order at each stage of the order process.

  • All orders are subject to acceptance and availability. On placing an order you undertake that you are at least 18 years old, that all details you provide to us are true and accurate, that you are an authorised user of the payment method used to place your order and that there are sufficient funds to cover the cost of the Goods.

  • After you place an order, you will receive an order confirmation email from us acknowledging that we have received your order. This email is not an acceptance of your order; it is a confirmation that we have received your order. Our acceptance of your order is described in the fourth point below.

  • We will confirm our acceptance of your order to you by sending you an email that confirms that the Goods have been sent ("Dispatch Confirmation"). The Contract between us will only be formed when we send you the Dispatch Confirmation. Only Goods dispatched will be included in the Contract.

  • We may choose not to accept your order at our discretion for any reason whatsoever without liability to you. Examples of when we may not accept your order includes (but are not limited to): (i) instances where the Goods ordered are out of stock or are incorrectly priced or do not satisfy our quality control standards, (ii) where payment has been declined, or (iii) upon a failed security review. We will inform you if we choose not to accept your order by email and we will not process your order. If you have already paid for the Goods, we will refund you the full amount as soon as possible. If an item from your order is unavailable, it will not be substituted for an alternative product and you will not be charged for the item.

  • To protect our customers and for security reasons, we regularly perform security checks on online orders. All digital orders are processed using our payment processor, and may be selected for review by our risk system. If your order has been selected for review, we may reach out to you and request additional information to validate your order such as a bank authorisation code and/or utility bill so we can verify your details. This security policy is in place for your protection. Should an order fail to pass the review, then the order will be cancelled, you will be sent an order cancellation email and your funds will be returned to your original form of payment.

    If we suspects or identifies fraudulent activity in violation of this Agreement, any law or regulation, or is likely to expose either Oud Section or any other party to harm or loss, we reserves the right to take the following actions, including but not limited to: (i) rejecting, cancelling, recalling or reversing the order; or (ii) taking any other appropriate steps to investigate the activity for security reasons.
CANCELLING AN ORDER

If you wish to cancel your order, please notify us via email at sales@oudsection.co.uk within 6 hours of placing your order. Once you have received the order dispatch confirmation email from us, cancellation is no longer possible as the goods/items are en route. However, you may still request a return or refund by contacting us at the same email address. For comprehensive details, please refer to Section "Returns and Refunds" below.

RETURNS AND REFUNDS

For hygiene and safety reasons, we do not accept returns or exchanges on our products once purchased. As they do not come with a tamper-evident seal, we cannot verify whether an item has been opened or used. This policy ensures the quality and safety of every product we offer. DELIVERY AND SHIPPING

All orders are shipped via Royal Mail. UK delivery options include Standard Shipping (£5.99, 5–7 business days) and Express Shipping (£8.99, next business day delivery, Monday–Friday). European shipping is £15.99 with an estimated arrival of 5–7 days. International orders (all regions) ship at £15.99, with delivery expected within approximately 2 weeks. TAXES AND DUTIES

Please note that all international orders (Outside UK) are shipped on a DDU (Delivered Duty Unpaid) basis. This means product prices do not include import duties, taxes, or customs fees. You will be responsible for any charges applied by the customs authorities in your destination country, including duties, sales taxes, clearance fees, and other related costs. These fees must be paid to release your order from customs, and we are unable to predict or reimburse these charges. We recommend checking with your local customs office to determine potential fees before placing an order.

PRICE OF GOODS

The price of the Goods will be as quoted on our Site at the time you submit your order. We take all reasonable care to ensure that the prices of Goods are correct at the time when the relevant information was entered onto the system. All prices shown include the applicable VAT. If the rate of any applicable VAT changes between the date of your order and the date.

Our Site contains number of items. It is always possible that, despite our best efforts, some of the items on our Site may be incorrectly priced. We will normally check prices as part of our dispatch procedures so that:

  • where the item's correct price is less than the price stated on our Site, we will charge the lower amount when dispatching the item to you. However, if the pricing error is obvious and unmistakable, we do not have to provide the item to you at the incorrect (lower) price.
  • If the item's correct price is higher than the price stated on our Site, we will contact you as soon as possible to inform you of this error and we will give you the option of continuing to purchase the item at the correct price or cancelling your order. We will not process your order until we have your instructions. If we are unable to contact you using the contact details you provided during the order process, we will treat the order as cancelled and notify you in writing.

Unfortunately, we cannot advise you in advance of any proposed reduction in prices or reimburse you the difference in the event that an item you order is subsequently reduced in price.

We may from time to time run special promotions or issue promotional codes. Unless otherwise expressly stated on the specific promotion, promotional codes cannot be used in conjunction with any other offer or promotion, cannot be used to purchase gift cards and can only be used against full price items. We reserve the right to change or terminate any promotion without notice at any time.

HOW TO PAY

You can only pay for items on our Site using any one of the following methods: Debit Card, Credit Card, Google Pay, Apple Pay, Shop Pay, Union Pay, Discover Pay, Pay with Diners Club, Pay with Klarna in Sterling (GBP) or any other methods which may be clearly indicated on our Site from time to time. Please note exclusions may apply with the availability of payment methods.

We accept the following debit or credit cards: Visa, Mastercard, American Express and Maestro. When you use a payment card you confirm that the card being used is yours or that you have been specifically authorised by the owner of the payment card to use it.

All payments are subject to validation checks and authorisation by the payment service provider. If the payment service provider refuses to authorise payment to us, we will not be liable for any delay or non-delivery. If you are a customer whose payment service provider is not denominated in Sterling, the final price will be calculated in accordance with the applicable exchange rate on the day your card issuer processes the transaction.

LIABILITY

If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our negligence, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if they were an obvious consequence of our breach or if they were contemplated by you and us at the time we entered into the Contract.

We only supply the Goods for domestic and private use. You agree not to use the product for any commercial, business or resale purposes, meaning we only issue invoices that are addressed to customers, not businesses. We have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

EVENTS OUTSIDE OUR CONTROL

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by an Event Outside Our Control. An Event Outside Our Control means any act or event beyond our reasonable control, including without limitation: strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, severe weather conditions, flood, earthquake, subsidence, epidemic, pandemic or other natural disaster, adverse weather conditions, or failure of public or private telecommunications networks or impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.

If an Event Outside Our Control takes place that affects the performance of our obligations under a Contract:

  • We will contact you as soon as reasonably possible to notify you.
  • Our obligations under a Contract will be suspended and the time for performance of our obligations will be extended for the duration of the Event Outside Our Control. Where the Event Outside Our Control affects our delivery of Goods to you, we will arrange a new delivery date with you after the Event Outside Our Control is over.

You may cancel a Contract affected by an Event Outside Our Control which has continued for more than 30 days. To cancel please contact us. If you opt to cancel, you will have to return (at our cost) any relevant Goods you have already received and we will refund the price you have paid, including any delivery charges.

OTHER TERMS

We may transfer our rights and obligations under a Contract to another organisation, but this will not affect your rights or our obligations under these Terms.

This Contract is between you and us. No other person shall have any rights to enforce any of its Terms, whether under the Contracts (Rights of Third Parties Act) 1999 or otherwise.

Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.

If we fail to insist that you perform any of your obligations under these Terms, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.

These Terms and any dispute or claim arising out of or in connection with such matters, their subject matter or formation (including but not limited to non-contractual disputes or claims) shall be governed by, construed and interpreted in accordance with the laws of England and Wales and you agree to submit to the non-exclusive jurisdiction of the English Courts.

Where these Terms are translated into languages other than English in the event of any conflict or inconsistency the English language Terms shall prevail.

We reserve the right to bring proceedings in the Courts of the:

  • country of your residence;
  • location of your access or use of the Site;
  • location of any breach by you of these Terms; and/or
  • location of your authorisation of any of the above acts.

You acknowledge and agree that damages alone would not be an adequate remedy for any breach of the terms of these Terms. Accordingly, we shall be entitled to the remedies of injunction, specific performance or other equitable relief for any threatened or actual breach of the terms of these Terms.

CUSTOMERS DATA

We would like to repost product reviews our customers leave on social media platforms (“Posts”) sometimes. Before we do this, we’ll send you an email or a DM requesting permission to do so.

By consenting, you provide Oud Section with the following:

  • a worldwide, royalty free, licence to use the Posts in connection with the exploitation, marketing, advertising and promotion of the Oud Section brand and/or its products on the Oud Section website and its social media platforms; and
  • a non-exclusive, worldwide, royalty free licence to use your name, voice, image, and/or likeness as comprised in the Posts to the fullest extent in connection with the purposes set out above.

You may request that we do not use your Posts in such a way by writing to us at sales@oudsection.co.uk.

Any personal information collected by us will be processed in accordance with our Privacy Policy.
